**Definitions and General Concepts**
*You, the Renter* refers to the drivers and payers mentioned in the rental agreement who have signed as the renter.

**Eligibility to Rent a Car**
You must provide us with the necessary documents and information to establish your rental agreement, including your identity and passport, address (residence and email), landline and mobile phone numbers, the issue and expiration dates of your driver’s license along with the place of issue, and payment methods for your rental. Every driver must have held a valid driver’s license for at least 12 months corresponding to the category of the rented vehicle. They must also be over 21 years old (the required age may be higher for certain categories of vehicles). A “young driver tax” may apply if you are between 18 and 20 years old, averaging about 200.00 MAD per day.
At the start of the rental, you will need to make an advance payment for the anticipated cost of the rental, plus the security deposit.
**Vehicle Condition**
A document detailing the condition of the vehicle will be attached to your agreement. You agree to note any visible damages not described before leaving the station. If not, you will be deemed to have received the vehicle in the stated condition. We cannot accept claims for visible damages not reported at the time of departure. You must return the vehicle in the same condition you received it. Any cost of restoring the vehicle due to the renter’s fault will be added to the rental cost.
**Vehicle Usage**
You must never drive the vehicle outside Morocco (across the border) without written authorization from Fascinocars.
According to the principle of personal penalties, you are responsible for any infractions committed during the rental period. As such, you are informed that your details may be shared with the police authorities upon request.
You agree to use the vehicle in a cautious and reasonable manner, including not driving under the influence of alcohol, drugs, or any substance that may impair your driving ability, in accordance with the Highway Code and its intended use, which primarily means the free transport of people for a passenger car.
**ATTENTION:** Specifically, you must not use the rental vehicle for:
– Sub-renting it;
– Transporting passengers for payment;
– Transporting more passengers than stated on the vehicle’s registration certificate;
– Participating in rallies, competitions, or trials, regardless of location;
– Giving driving lessons;
– Pushing or towing another vehicle;
– Driving on an unsuitable road for motor vehicles, or one whose surface or condition poses risks for tires or the vehicle’s underside;
– Committing national/international infractions;
– Driving off-road, in mountains, etc.
Fascinocars allows pets to travel in rental vehicles. However, cleaning and detailing fees may apply.
Goods and luggage transported in the vehicle, including their packaging and securing, should not damage the vehicle or pose unreasonable risks to its occupants. When parking the vehicle, even for a short stop, you agree to lock the vehicle and use the alarm and/or anti-theft devices installed in the vehicle (if applicable).
You must never leave the car unattended with the keys in the ignition. Failing to return the keys voids theft waivers. In the case of damage or theft, you must promptly provide the company with the accident report or the theft declaration receipt issued by the authorities, along with the vehicle keys and documents.
**Maintenance / Mechanical Issues**
During your rental and depending on the mileage covered, you will need to carry out routine inspections (oil level after 1,000 km, tire pressure, etc.) in line with reasonable and prudent use. The renter must stay alert to dashboard warning signals and take necessary precautions, such as an emergency stop.
The vehicle is provided with five tires that meet traffic regulations. If one is damaged for reasons other than normal wear, a latent defect, or force majeure, you agree to immediately replace it at your own expense with a tire of the same size, type, brand, and wear.
In the event of a mechanical breakdown only (excluding accidents), you are entitled to assistance, which is included in the rental price. The terms of this assistance are outlined in Article 8 below: “Insurance, Assistance, and Helpful Advice.”
**ATTENTION:** Fascinocars does not guarantee a specific model or color but reserves the right to make adjustments if necessary. However, we guarantee the category of your choice, and if unavailable, a higher category will be provided.
**Rental Duration – Calculation Definition**
The renter agrees to return the vehicle to the company on the specified date in the rental agreement, under penalty of civil and criminal action. The rental period is determined by an indivisible 24-hour period, starting from the time the vehicle is made available; however, you benefit from a 29-minute tolerance at the end of the rental before a new 24-hour period is applied. If you wish to keep the vehicle beyond the period specified in the agreement, you must first go to the Fascinocars office to extend the rental agreement and pay for the additional rental period.
**End of Rental**
The rental ends when the vehicle, keys, and documents are returned to the company counter and a Fascinocars agent. Under no circumstances should you hand over the keys to people in parking lots claiming to be Fascinocars agents. If the vehicle is returned without its keys, the cost of their replacement will be charged to the renter, along with the vehicle’s repatriation cost. Vehicle repatriation will be charged at 5 MAD/km (VAT included) to the nearest Fascinocars station. The company is not responsible for goods left in the vehicle at the end of the rental.
**ATTENTION:** Only returning the vehicle, documents, and keys to the rental agent during office hours concludes the rental agreement. Reminder: you are responsible until the end of the rental agreement. Exceptions: if the vehicle is confiscated, the rental agreement may be terminated as soon as the company is informed by judicial authorities or the renter. Any use of the vehicle that harms the company authorizes it to terminate the rental agreement with immediate effect. In this case, the company reserves the right to claim damages for any loss suffered.
**Financial Conditions**
Payment for your rental is made by credit card only. We accept the following bank cards for rental payment: Visa, Mastercard, American Express. The renter is always personally responsible for payment, including if the billing account is transferred to a third party (credit or otherwise).
The renter expressly agrees that non-payment of any invoice or amount due under the rental agreement will immediately make all outstanding invoices due, and authorizes the company to demand the immediate return of vehicles currently rented. The client will pay all invoices for closed rental contracts.
**Applicable Prices**
The prices applicable to the rental, additional services, and optional insurance or options will be those in effect at the time the contract is signed, based on the information you provided (duration, return station, etc.). Any change in this information will result in the application of a substitute price, as stated in the brochure for the agreed price. Fuel is not included in the base rental rate. The company rents vehicles with the same fuel level, and the client must return the vehicle with the same amount of fuel and pay for any fuel missing in the tank at the rate of 10 MAD/liter + 200 MAD refueling fee (VAT included). The amount of missing fuel is indicated in the closed rental contract.
**ATTENTION:** The client is fully responsible for the rented vehicle during the rental period. Malfunctions caused by refueling with the wrong type of fuel will be charged a minimum amount of 2,500 MAD deducted from the deposit.
The client pays for the cleaning of extremely dirty vehicles (inside or outside) at a cost of 600 MAD (VAT included).
The client pays for additional equipment such as child safety seats at 60 MAD per day, with a maximum of 500 MAD per rental. A destroyed child seat will be charged 1,200 MAD. The cleaning of an extremely dirty child seat will be charged 120 MAD.
The client will cover the total value of damages not covered by the insurance on the following vehicle parts: wheels, hubcaps, underside, rims, interior, and radio.
For a destroyed/damaged tire, the client will be charged 2,500 MAD per piece.
The client will pay the total value of lost vehicle keys/alarms/documents: 1,500 MAD per piece.
The client will pay 250 MAD for the loss of the vehicle’s registration plate.
For unauthorized return of the vehicle outside Moroccan borders (if applicable), the renter will be charged a one-way international travel penalty of 30,000 MAD.
One-way rentals are available; return fees may apply. Special equipment/optional extras can be requested at the time of booking but are not included in the rental price. These are paid in local currency at the rental counter.
**Early Returns / Unused Rental Days**
If the renter decides to return a Fascinocars vehicle earlier than scheduled, no refund will be given for unused rental days. No refunds (partial or full) will be granted for prematurely ended rentals, including for auxiliary item purchases, late collections, absences, or cancellations made after the scheduled rental start date.
The product is non-refundable in the following cases:
– You did not inform us of the cancellation before your pickup.
– You did not pick up the car at the agreed time and date.
– You did not provide the required documents (passport and driver’s license) to pick up the car.
– You did not provide a credit card with sufficient funds and with the main driver’s name printed on it.
– You have been blacklisted by the car rental company.
In all these cases, no refund will be issued.
**Cancellation Policy**
Any cancellation made with less than 48 hours’ notice will incur a fee of 800 MAD. No refund will be made if cancellations are made after the scheduled pickup time and date.
**Insurance and Assistance Conditions – LIABILITY INSURANCE**
All our vehicles are covered by liability insurance in accordance with the laws and regulations in force in Morocco. They are also covered by a technical assistance contract with Fascinocars’ rental stations and their contractual partners, which will be indicated to the client when requesting assistance from the nearest Fascinocars rental station.
The client can also opt for additional driver and passenger insurance (referred to as PAI or checked on the agreement) by paying a fixed rate per rental day.
The conditions and limitations of mandatory or optional insurance, contractual guarantees, and assistance will be outlined in the brochure “Rental Guide, Insurance Conditions, and Useful Advice” available at all Fascinocars rental stations.
**Late Arrival Policy**
Reservations will be held for two (2) hours after the scheduled pickup time, unless you contact us to change your arrival time. Two hours after the scheduled pickup time, the reserved vehicle will be made available to other customers. If you arrive more than two hours after the scheduled pickup time, we will try to provide a vehicle, but availability cannot be guaranteed.
In case of flight delay, if the new arrival time is outside the rental station’s opening hours, the stations will remain open, provided that the correct flight number is included in the booking, and the airline has notified the delay and new arrival time. After-hours fees apply.

CANCELLATION
Cancellations can be made up to 48 hours before the scheduled pick-up time for a full refund. Cancellations made within 48 hours of the rental start time may incur a cancellation fee.
No-Show: If the renter does not show up to pick up the vehicle at the agreed time and location, no refund will be provided.
